Resumen
[ES] El acceso a la información pública es una de las vías principales para conseguir una Administración transparente y al servicio de los ciudadanos. Conocer las razones que han llevado al ente público a actuar de una determinada manera, cerciorar el cumplimiento exacto de todos los deberes por parte de la Administración y posibilitar una indemnización al ciudadano por los daños causados en caso de no haber obedecido a estos son algunas de las consecuencias que se desprenden del derecho de acceso a información pública. Por su parte, el derecho a una buena administración se instaura en nuestro ordenamiento como un principio bifronte. Por un lado, como el deber de las Administraciones de actuar respetando los derechos de los ciudadanos, ofreciendo todas sus garantías y actuando bajo los principios de eficacia, eficiencia y transparencia. Y por otro, el derecho de los administrados a exigir el cumplimiento exacto de estas premisas en cada actuación administrativa y la responsabilidad de la Administración en cada una de ellas. Una buena administración traerá consigo un aumento del “Buen Gobierno”, dotará al ciudadano de los derechos necesarios para enfrentarse a la Administración desde una posición más cercana y favorecerá la satisfacción de las necesidades mínimas que se requieran, cometido principal y razón sobre la que se sustenta el sentido de la Administración Pública. Sin un procedimiento seguro y donde el acceso a la información pública esté nutrido de derechos para el solicitante será imposible alcanzar dicho objetivo, por lo que se analizarán las deficiencias con que cuenta nuestra actual regulación en la materia y se demostrará la necesidad urgente de solventarlas si se quiere lograr el ansiado propósito de un gobierno transparente: una buena administración. [EN] Access to public information is one of the main ways to achieve a transparent administration at the service of citizens. Knowing the reasons that have led the public body to act in a certain way, ascertaining the Administration's exact compliance with all its duties and making it possible to compensate the citizen for damages caused in the event of not having complied with these are some of the consequences that arise from the right of access to public information. For its part, the right to good administration is established in our legal system as a two-pronged principle. On the one hand, as the duty of administrations to act respecting the rights of citizens, offering all their guarantees and acting under the principles of effectiveness, efficiency and transparency. And on the other hand, the right of the administered to demand exact compliance with these premises in each administrative action and the responsibility of the Administration in each of them. Good administration will bring with it an increase in "Good Governance", will provide the citizen with the necessary rights to face the Administration from a closer position and will favour the satisfaction of the minimum needs required, the main task and reason on which the meaning of Public Administration is based. Without a secure procedure in which access to public information is nourished with rights for the applicant, it will be impossible to achieve this objective. Therefore, we will analyse the deficiencies of our current regulation in this area and demonstrate the urgent need to solve them if we want to achieve the desired purpose of a transparent government: a good administration.
