dc.description.abstract | [ES] En la actualidad, la Administración tributaria lleva a cabo un almacenamiento masivo de datos de los contribuyentes y a través de mecanismos de Inteligencia artificial los analiza y procesa para tomar decisiones automatizadas, sin intervención, o con la más mínima intervención humana. La utilización de estas nuevas tecnologías en los procedimientos tributarios conlleva ventajas como una mayor eficiencia de los procesos o facilidades para la detección y control del fraude fiscal, sin embargo, estas técnicas plantean desafíos éticos y jurídicos que es preciso analizar, sobre todo, en relación con las garantías y derechos de los obligados tributarios debido a la incidencia en los principios de privacidad, transparencia y seguridad y derivados de la opacidad en el funcionamiento de los sistemas de Inteligencia artificial utilizados por la Administración tributaria. Este estudio se centra en primer lugar en el análisis del uso de mecanismos de Big data o Inteligencia artificial utilizados por la Administración tributaria en sus actuaciones o procedimientos, y en segundo lugar, y como consecuencia de lo anterior, en los derechos o garantías de los contribuyentes que se ven afectados por la utilización de este tipo de tecnologías. | es_ES |
dc.description.abstract | [EN] Currently, the Tax Administration carries out a massive storage of taxpayer data and, through artificial intelligence mechanisms, analyzes and processes them to make automated decisions, without intervention, or with the slightest human intervention. The use of these new technologies in tax procedures entails advantages such as greater efficiency of the processes or facilities for the detection and control of tax fraud; however, these techniques pose ethical and legal challenges that must be analyzed, above all, in relation to with the guarantees and rights of the taxpayers due to the impact on the principles of privacy, transparency and security and derived from the opacity in the operation of the artificial intelligence systems used by the tax administration. This study focuses firstly on the analysis of the use of big data or artificial intelligence mechanisms used by the Tax Administration in its actions or procedures, and secondly, and as a consequence of the above, on the rights or guarantees of taxpayers. taxpayers who are affected by the use of this type of technology. | es_ES |
