Análisis de los derechos de acceso a la Justicia y asistencia jurídica gratuita en los conflictos transnacionales

Abstract

[ES] La cooperación judicial internacional en materia civil, tal y como la conocemos hoy en día, es consecuencia de una larga evolución a lo largo de los años. Su origen se circunscribe en la integración de ésta en el Tratado de Maastricht como objetivo fundamental a seguir por las instituciones y Estados que forman parte de la Unión Europea. Ello supuso la obligación de elaborar de forma progresiva y eficaz una serie de instrumentos jurídicos vinculantes que tratasen de garantizar esa cooperación entre los Estados Miembros, haciendo hincapié además, en la necesidad de llevar a cabo la firma de sucesivos Convenios en distintas materias relacionadas con la cooperación judicial, con el fin principal de asegurar una seguridad jurídica entre los ciudadanos de los Estados, así como garantizar la misma aun cuando medie elemento transfronterizo. Reconociendo, por tanto, los derechos de acceso a la Justicia y el de asistencia jurídica gratuita como piezas fundamentales aplicables a todos los ciudadanos.

[EN] International judicial cooperation in civil matters, as we know it today, is the result of a long evolution over the years. Its origins can be traced back to its inclusion in the Maastricht Treaty as a fundamental objective to be pursued by the institutions and States that form part of the European Union. This entailed the obligation to progressively and effectively draw up a series of binding legal instruments that sought to guarantee this cooperation between the Member States, also emphasising the need to sign successive Conventions on different matters related to judicial cooperation, with the main aim of ensuring legal certainty between the citizens of the States, as well as guaranteeing the same even when there is a cross-border element. Recognising, therefore, the right of access to justice and the right to free legal aid as fundamental elements applicable to all citizens.
