El marco regulador del trabajo doméstico, especial atención a la nueva prestación por desempleo

Abstract

[ES] La regulación del trabajo doméstico en el Real Decreto Legislativo 16/2022 ha permitido a sus afiliados obtener la prestación por desempleo, sin duda uno de los derechos más significativos adquiridos para este colectivo. Resaltando la importancia de la evolución histórica y legislativa, se pone de manifiesto lo limitadas que son las prestaciones para estos trabajadores en comparación con otras. La lucha de estos empleados, con el objetivo de equiparar sus condiciones a las de los demás trabajadores, ha llevado a la consecución de derechos relacionados con la prevención de riesgos, la protección frente a la extinción del contrato de trabajo y las cotizaciones. Lo que ha permitido alcanzar derechos que hasta hace poco eran imposibles. En este contexto, cabe destacar la importancia de la Unión Europea y la influencia que ha tenido en el desarrollo profesional de este colectivo, posibilitando nuevas protecciones sociales. Simultáneamente, el Real Decreto ha conseguido lo que antes quedaba en la incertidumbre legislativa.

[EN] The regulation of domestic work in Royal Legislative Decree 16/2022 has allowed its affiliates to obtain unemployment benefits, undoubtedly one of the most significant rights acquired for this group. Highlighting the importance of historical and legislative evolution, it becomes evident how limited the benefits for these workers are in comparison to others. The struggle of these employees, with the aim of aligning their conditions with those of other workers, has led to the attainment of rights related to risk prevention, protection against termination of employment contracts, and contributions. This has made it possible to achieve rights that were until recently impossible. In this context, it's worth emphasizing the importance of the European Union and the influence it has had on the professional development of this group, enabling new social protections. Simultaneously, the Royal Decree has achieved what was previously left in legislative uncertainty.
