Legalidad Penal, sus enemigos y el derecho internacional

Abstract

[ES] Al incorporar el principio de legalidad penal en las constituciones, puede parecer que la violación de este principio es solo un problema en Estados autoritarios. Sin embargo, sostenemos que esta idea no es correcta. De hecho, bajo el discurso constitucional predominante, especialmente en América Latina, es posible mantener formalmente la vigencia del principio de legalidad mientras se legitiman sus violaciones. En este sentido, exploramos las raíces del problema en la fórmula Radbruch y en la teoría iusmoralista del derecho del profesor Robert Alexy, quien ha desarrollado una teoría que permite relativizar el contenido de las normas sin que parezca que se están ignorando. La solución a esta disfuncionalidad se encuentra en una dogmática de derecho penal mínimo y garantista, así como en el cumplimiento de los sistemas internacionales de protección de los derechos humanos, los cuales sancionan a los Estados que violen garantías fundamentales.

[EN] By incorporating the principle of legality in Criminal Law into constitutions, it may be thought that the violation of this principle is only a matter for authoritarian states. However, we argue that this thesis is incorrect. In fact, under much of the prevailing constitutional discourse, particularly in Latin America, it is possible to maintain the formal validity of the principle of legality while legitimizing its violations. Here, we explore the roots of the problem in Radbruch’s formula and in the iusmoralist theory of law by Professor Robert Alexy, who has developed a theory that allows for the relativization of the content of norms without appearing to ignore them. The solution to this dysfunctionality can be found in a minimalist and guarantee-oriented theory of criminal law, as well as in compliance with international systems for the protection of human rights, which sanction states that violate them.
