dc.description.abstract | 本文考察中华人民共和国对立法权在中 央和地方之间的分配。鉴于特别行政区制度 在中国乃至全球都颇具特色,香港特别行政 区和澳门特别行政区的立法权问题专门进行 阐述。之后,文章分析了法律规范层次结构 和解决法律规范冲突的方法。最后,讨论了 通过备案制度,避免上下级法律之间出现冲 突,并且提及了对立法予以撤销的可能性。 This paper examines the allocation of the legislative authority of the People’s Republic of China between the central and local bodies. Given that the special administrative region system is the most characteristic, both in China and globally, a part is retained for the legislation of Hong Kong and Macao. Next, the paper analyzes the hierarchy of legal norms and the method to resolve conflicts between legal norms.the registration system is discussed to avoid contravention between the lower level law and the higher level, also, the possibility of cancellation is mentioned. | es_ES |
