Derechos en materia de protección y asistencia social para la víctima de violencia de género

Abstract

[ES] Las víctimas de violencia de género están amparadas principalmente en el ordenamiento jurídico español por la Ley Orgánica 1/2004, de 28 de diciembre, de medidas de protección integral contra la violencia de género. Además de la tutela de esta ley cuentan con otras fuentes de derechos tanto en materia de protección como de asistencia social dirigidas a ellas y sus familiares, a los cuales alcanza también esta violencia. Es por ello que este trabajo se ha centrado en las medidas y ayudas que estas víctimas tienen y pueden solicitar en materia económica, laboral o de asistencia social, tanto del Estado como de las Comunidades Autónomas, para protegerlas ante sus agresores y evitar el desamparado ante dicha violencia. Gracias a todas estas disposiciones se está intentando, poco a poco, erradicar de raíz este tipo de violencia y que estas mujeres conozcan todos los derechos que tienen.

[EN] Victims of gender-based violence are mainly protected in the Spanish legal system by Organic Law 1/2004, of 28 December, on comprehensive protection measures against gender-based violence. In addition to the protection provided by this law, they have other sources of rights in terms of protection and social assistance aimed at them and their family members, who are also affected by this violence. This is why this work has focused on the measures and aid that these victims have and can apply as regards economic, employment or social assistance, both from the State and the Autonomous Communities, to protect them from their aggressors and to prevent them from being helpless in the face of this violence. Thanks to all these provisions, attempts are being made, little by little, to eradicate this type of violence at its roots and to ensure that these women are aware of all the rights they have.
