Algunas consecuencias jurídicas que se pueden derivar de la entrada en vigor de la Ley Trans

Abstract

[ES] Este estudio realiza un análisis jurídico feminista de una parte de los contenidos de la Ley 4/2023, de 28 de febrero y algunas consecuencias que pueden derivarse de la entrada en vigor de la Ley. Se estudió la normativa de otros países europeos para comparar el tratamiento dado a menores con disforia de género. Se constata la sustitución del sexo por el género en parte del texto legal, dando lugar a cierta confusión terminológica tan contraria a la certeza que exige el Derecho. Por otra parte, se centró en examinar la diferente manera en la que afecta el texto legal a mujeres y a varones. Finalmente, se analizó el sistema sancionador que prevé la norma y los ámbitos en los que puede afectar preferentemente: el familiar, educativo y sanitario.

[EN] This study carries out a feminist legal analysis of a part of the contents of Law 4/2023, of February 28 and some consequences that may arise from the entry into force of the Law. The regulations of other European countries were studied to compare the treatment given to minors with gender dysphoria. The substitution of sex for gender in part of the legal text is verified, giving rise to a certain terminological confusion so contrary to the certainty required by law. On the other hand, it focused on examining the different way in which the legal text affects women and men. Finally, the sanctioning system provided by the norm and the areas in which it can preferably affect: family, educational and health.
