[ES] Hablar de reforma laboral en España es rememorar un largo y tedioso transcurso de cambios normativos que, desde la aprobación del Estatuto de los Trabajadores en el año 1980, no han podido eliminar y combatir con acierto dentro del mercado laboral español los atributos de temporalidad y precariedad. Se adopta como punto de partida un nocivo contexto social provocado, primeramente, por la precedente reforma laboral de 2012 que, lejos de combatir el problema, contribuyó a potenciar tales desequilibrios. Asimismo, es menester no desdeñar el fuerte impacto de la crisis sanitaria y económica a resultas de la pandemia del COVID-19 y las consiguientes medidas laborales adoptadas tendentes a adaptarse al nuevo marco social y normativo. Finalmente, cabe tomar en consideración las continuas advertencias y recomendaciones europeas en torno a los problemas con la contratación temporal en el sistema español de relaciones laborales. Tras largos meses de diálogo social y tomando como faro la reversión de los calificativos antes reseñados, temporalidad y precariedad, la tan ansiada reforma laboral de 2021 sale a la luz a través del Real Decreto-Ley 32/2021. Entre su contenido, se propone revertir la excesiva tasa de temporalidad, simplificar las modalidades contractuales de carácter temporal y estabilizar el empleo fomentando y reforzando la contratación indefinida. Sin haber alcanzado los doce meses desde su plena entrada en vigor, ya existen indicios fundados de un verdadero impacto positivo en el mercado de trabajo español. [EN] Talking about a labor reform in Spain would lead to reminisce a long and tedious course of regulatory changes that, since the approval of the Workers’ Statute in 1980, they have not been able to eliminate and successfully remove the attributes of temporality and precariousness from the Spanish labor market. The starting point that has been adopted is a harmful social context caused, firstly, by the previous labor reform of 2012, which, far from combating the problem, contributed to empowering such imbalances. Likewise, it is necessary not to disregard the strong impact of the health and economic crisis as a result of the COVID-19 pandemic and the consequent labor measures adopted trying to adapt the labor market to the new social and regulatory framework. Finally, it is worth taking into consideration the continuous European warnings and recommendations regarding the problems of temporary hiring in the Spanish labor relationship system. After long months of social dialogue and taking as a lighthouse the reversal of aforementioned qualifiers, temporality and precariousness, the long-awaited labor reform of 2021 comes to light trough the Royal Decree-Law 32/2021. Among its contents, it is proposed to reverse the excessive rate of temporary employment, to simplify temporary contracts and to stabilize employment by promoting and reinforcing permanent contracts. Although it has not yet been in force for twelve months, there are already wellfounded indications of a real positive impact on the Spanish labor market.
