La culpabilidad penal. Especial consideración de la esquizofrenia

Abstract

[ES] La culpabilidad es el último presupuesto ineludible de la pena y, como tal forma parte del concepto de delito. La finalidad que persigue es la de poder reprochar a un sujeto una conducta ilícita como consecuencia de valoraciones jurídicas, es decir, al margen de la moral. Como elemento de esta culpabilidad encontramos la imputabilidad, que designa las condiciones que ha de reunir el autor para que un hecho cualquiera, por él realizado, pueda serle atribuido. En el extremo opuesto destaca la inimputabilidad, que es la ausencia de imputabilidad. Nuestro CP exige un presupuesto biológico (la anomalía o alteración psíquica), así como un elemento normativo, que consiste en que el sujeto, en el momento de cometer la infracción, no pueda comprender la ilicitud del hecho o actuar conforme a dicha comprensión. El actual CP ha regulado, además de la imputabilidad e inimputabilidad, las eximentes incompletas y la atenuante de análoga significación, elaborando, además, un sistema de medidas de seguridad que pretende dar solución a todas las situaciones que se puedan plantear. Determinadas alteraciones psíquicas son las que disminuyen o extinguen la culpabilidad, siendo la esquizofrenia una de las más estudiadas y ofreciendo, la praxis procesal, todo tipo de soluciones.

[EN] Culpability is the last penalty´s requirement, and as such it is part of the concept of crime. The purpose it pursues is to be able to reproach a person for an unlawful conduct because of legal assessments on the fringes of morality. As an element of the culpability, we find imputability, which designates the conditions that the person must meet for an act, performed by him, to be attributed to him. At the opposite end stands out inimputability, which is the absence of imputability. Our Criminal Code requires a biological presupposition (psychic anomaly or alteration), as well as a normative element, which consists of the subject, at the time of committing the infringement, may not be able to understand the unlawfulness of the act, or is unable to act in accordance with this understanding. The current Criminal Code has regulated, in addition to imputability and inimputabilty, the incomplete exoneration and the mitigating factor of similar significance, making a security measures system which solves the situations that can be raised. Schizophrenia is one of the most studied psychic alterations, and it offers many solutions in the procedural law praxis.
