Acceso a la Justicia y legitimación medioambiental en el proceso español. Últimos avances y algunos retos

Abstract

[ES] El interés del contenido de la presente Tesis Doctoral estriba principalmente en el acierto en la elección del tema objeto de análisis. Y ello por dos razones: en primer lugar, por la consideración de reto multidisciplinar que tiene hoy día la investigación en materia medioambiental, que da fe de su relevancia científica, tal y como expongo en el apartado de Introducción y en particular en la Justificación del tema de investigación. Y en segundo lugar, la segunda razón del acierto estriba en que, por tratarse de una Tesis Doctoral de contenido procesal –y por consiguiente desde la perspectiva y metodologías propias de esta disciplina-, permite el mejor enfoque tendente a solventar las dificultades e insuficiencias propias de nuestra legislación interna, en orden a optimizar la implementación de las enseñanzas derivadas principalmente del Convenio de Aarhus en materia de acceso a la Justicia y legitimación medioambiental. Todo ello a través de una rigurosa utilización de los postulados propios de nuestra disciplina procesal, lo que incluye asimismo las herramientas que nos facilita el Derecho Procesal a través de la debida utilización de su indiscutible transversalidad.

Con esas premisas, se acomete el presente trabajo de investigación, cuyo resultado está expuesto en las páginas que siguen, pudiendo afirmar sin falsa modestia que contribuye al esclarecimiento de los principales problemas afectantes al acceso a la Justicia y la regulación de la legitimación en los diversos órdenes jurisdiccionales del sistema español, con aportación de la visión crítica precisa para ayudar a la resolución de los retos que plantea la materia en análisis.

[EN] The interest of the content of this Doctoral Thesis lies mainly in the correct choice of the subject to be analysed. And this is for two reasons: firstly, because of the multidisciplinary challenge that environmental research is considered to be today, which attests to its scientific relevance, as I explain in the Introduction section and in particular in the Justification of the research topic. Secondly, the second reason for its success lies in the fact that, as it is a Doctoral Thesis of procedural content - and therefore from the perspective and methodologies of this discipline - it allows the best approach to solve the difficulties and insufficiencies of our domestic legislation, in order to optimise the implementation of the teachings derived mainly from the Aarhus Convention on access to Justice and environmental legitimation. All of this through a rigorous use of the postulates of our procedural discipline, which also includes the tools provided by Procedural Law through the due use of its unquestionable transversality.

With these premises, the present research work is undertaken, the result of which is set out in the following pages, and it can be stated without false modesty that it contributes to the clarification of the main problems affecting access to Justice and the regulation of legal standing in the different jurisdictional orders of the Spanish system, with the contribution of the critical vision required to help resolve the challenges posed by the matter under analysis.
