Reforma judicial feminista: el Derecho y los derechos

Abstract

[ES] La “Reforma Judicial Feminista” es una de las demandas sostenidas de los colectivos de mujeres y feministas en Argentina que pugna por ingresar en la agenda estatal. El presente trabajo tiene como objetivo conocer cuáles son las dimensiones de esa demanda a partir del análisis teórico de producciones académicas e investigaciones empíricas, que permitan reconstruir los ejes que la integran y constituyen. En ese sentido, se identifican tres dimensiones centrales: la introducción de la perspectiva de género en el quehacer jurisdiccional, el techo de cristal, y las violencias propias que se suceden al interior del espacio de trabajo contra funcionarias y trabajadoras del poder judicial. Las mismas serán analizadas a la luz de las categorías clave de la teoría feminista.

[EN] The “Feminist Judicial Reform” is one of the sustained demands of women's and feminist groups in Argentina, which struggles to enter the state agenda. The objective of this work is to know the dimensions of the demand for "feminist judicial reform" from the theoretical analysis of academic productions and empirical research, which will allow us to reconstruct the pillars that integrate and constitute it. In this sense, three central dimensions are identified: the introduction of the gender perspective in judicial work, the glass ceiling, and the violence that occurs within the workplace against women officials and workers of the judiciary. They will be analyzed in light of the key categories of feminist theory.
