El accidente in itinere

Abstract

[ES] En el presente trabajo se pretende realizar un estudio desde un punto de vista jurídico la figura del accidente in itinere. El punto de partida es el accidente laboral, siendo necesario determinar cuáles son los elementos que lo configuran, ya que son esenciales para que concurra el llamado accidente in itinere. Por lo cual el accidente in itinere hace referencia a un tipo concreto de accidente laboral, siendo el que ocurre en el trayecto entre el lugar de trabajo y la casa, o viceversa. Dicho de otro modo, es el accidente que ocurre cuando un trabajador se encuentra en el camino habitual de ida o regreso desde su casa hasta el centro de trabajo. Seguidamente, para confirmar que el accidente sufrido por el trabajador conlleva la connotación de “in itinere” es fundamental que concurran una serie de requisitos propios de este accidente, siendo el elemento teleológico, geográfico, cronológico e idoneidad del medio. Sin olvidar, la necesidad de que exista un nexo causal, ya que en caso contrario no podría subsumirse en este tipo de accidente. Por último, cabe destacar el comportamiento del sujeto porque puede llevar a la exclusión de este tipo de accidente, lo cual adquiere relevancia cuando al tratarse de dolo o imprudencia temeraria o profesional.

[EN] In this paper we intend to carry out a study from a legal point of view of the figure of the accident in itinere. The starting point is the occupational accident, being necessary to determine which are the elements that make it up, since they are essential for the so-called accident in itinere to occur. Therefore, the accident in itinere refers to a specific type of occupational accident, being the one that occurs on the way between the workplace and the home, or vice versa. In other words, it is the accident that occurs when a worker is on the usual way to or from home to the workplace. Next, in order to confirm that the accident suffered by the worker carries the connotation of "in itinere", it is essential that a series of requirements for this accident concur, being the teleological, geographical, chronological element and the suitability of the means of transport. Without forgetting the need for there to be a causal link, since otherwise it could not be subsumed under this type of accident. Finally, it is worth mentioning the behavior of the subject because it can lead to the exclusion of this type of accident, which becomes relevant when it is a case of malice or reckless or professional negligence.
