Artículo 25.2 CE: reeducación y reinserción social como fines de la pena

Abstract

[ES] El art 25.2 CE dispone que las penas privativas de libertad han de estar orientadas a la reinserción social y a la reeducación. En este trabajo se tratará de explicar el significado de esta afirmación, tomando en consideración también la teoría de los fines de la pena que se ha elaborado doctrinalmente. Una vez esclarecido el significado de lo estipulado en el art. 25.2 CE, y el significado de los términos reinserción social y reeducación, se hará una exposición sobre los mecanismos que ha dispuesto la Administración Penitenciaria para el cumplimiento de este fin de prevención especial positiva. En concreto, se hará referencia al tratamiento penitenciario, aludiendo además a algunos de los tratamientos dispuestos en IIPP para determinados supuestos especialmente problemáticos en la actualidad (violencia de género, delitos sexuales), y de qué manera el sistema de individualización científica regulado en la legislación penitenciaria sirve a la orientación hacia la reinserción social del penado.

[EN] The article 25.2 of the Spanish Constitution provides that custodial sentences must be aimed at social reintegration and re-education. In this work we will try to explain the meaning of this statement, also taking into consideration the theory of the purposes of punishment that has been developed doctrinally. Once the meaning of what is stipulated in the article 25.2 of the Spanish Constitution, and the meaning of the terms social reintegration and reeducation, a presentation will be made on the mechanisms that the Penitentiary Administration has established to fulfill this purpose of special positive prevention. Specifically, reference will be made to penitentiary treatment, also referring to some of the treatments provided in Penitentiary Institution for certain cases that are especially problematic today (gender violence, sexual crimes), and how the system of scientific individualization regulated in legislation penitentiary serves to guide the social reintegration of the prisoner.
