dc.description.abstract | [ES] La Jurisdicción ordinaria del Estado español se organiza en cuatro órdenes jurisdiccionales, lo que obliga a realizar un reparto de competencias entre los mismos. En esta labor, hasta cierto punto inevitable es la aparición de “zonas grises”, ámbitos limítrofes integrados por cuestiones litigiosas cuya atribución al conocimiento de los órganos jurisdiccionales de uno u otro orden es puesta en duda en la práctica forense. Surgen así los conflictos de competencia entre órdenes jurisdiccionales, como institución prevista para dar respuesta a estas materias fronterizas. En nuestro vigente ordenamiento jurídico constitucional, sucede que la relación competencial que se ha mostrado más conflictiva es la que vincula al orden social con el orden contencioso-administrativo, abocando a los justiciables a un auténtico “peregrinaje jurisdiccional” en el ejercicio de determinadas pretensiones que se han ido sometiendo a oscuros y vacilantes criterios de atribución, poniendo con ello en jaque el debido principio de seguridad jurídica y el derecho fundamental a la tutela judicial efectiva, pilares de todo Estado de Derecho que se precie. Se estudia en esta obra, con visión crítica, la actual configuración jurídico-positiva de la competencia genérica del orden social y del orden contencioso, analizando asimismo las principales materias objeto de conflicto. | es_ES |
dc.description.abstract | [EN] The Ordinary Courtsof the Spanish Stateare organized into four Jurisdictional Orders, what forces toconduct a competence distribution among them. In this task, the appearance of “grey zones” is,to some extent,unavoidable, bordering fields built into litigious issues which assignment to the knowledge of the Courts of one or another Orderis questionedat the judicial practice. Thus, conflicts of competenceamong Jurisdictional Ordersemergeas an envisaged institution expected to respond these bordering subjects. In our currentconstitutional legal system, thecompetence relationship which has showed as the most problematic is the one that links the Labour Courts with the Contentious-administrative Tribunals, leading the citizens to an authentic “jurisdictional pilgrimage”in the exercise of certain claims which have been subjected to dark andhesitant assignment criteria, thwartingthe due principle of legal certainty and thefundamental right to proper judicial protection, pillars of the rule of law. This work has the goal to study, with a critical look, the current legal configuration of the Labour Courts and Administrative Courts genericcompetence, analysing the main problematic subjects as well. | es_ES |
